Business Partner Terms

These terms apply to every business that has a commercial agreement with us to have its products or services shown, compared or sold through bonkers.ie. They are written to comply with the EU Platform-to-Business Regulation (Regulation (EU) 2019/1150).

About these terms

In short: these terms sit alongside your agreement with us, are free to read at any time, and will always be at this address.

  1. In these terms, "we", "us" and "Bonkers" mean Bonkers Money Limited, trading as bonkers.ie, a company registered in Ireland (number 477742) with its registered office at Nutley Building, Nutley Lane, Dublin 4. "You" means a business that has, or is negotiating, a commercial agreement with us (a "Partner Agreement").
  2. These terms form part of every Partner Agreement. If anything in a Partner Agreement conflicts with these terms, these terms apply to the extent needed to comply with the P2B Regulation.
  3. These terms are publicly available, without login, at www.bonkers.ie/partners/terms/ and are linked from the footer of every page of our website. We give a copy or link to every prospective partner before a Partner Agreement is signed. Previous versions are listed in section 13.
  4. These terms do not apply to consumers using our website. Consumers are covered by our Terms of Use and Privacy Policy.

What we do for you

In short: we show your products to consumers, help them compare, and pass their applications to you. You provide the product and contract directly with the customer.

  1. We operate online comparison and switching services for household energy, broadband, phone and TV, mobile, insurance, mortgages, savings, and other financial products. We display your products to consumers, enable them to compare those products with others, and, where agreed, pass their applications to you.
  2. The contract for your product or service is between you and the customer. Where we act as a regulated insurance or mortgage credit intermediary, our regulatory obligations to consumers also apply.
  3. The fees you pay us, and any service levels, are set out in your Partner Agreement.

How results are ranked

In short: by default, results are ordered by the cost to the consumer based on the details they give us. What you pay us never affects where your products appear.

  1. Ranking is determined by your product data, combined with the preferences the consumer gives us and the products they are eligible for. The main parameters, and their relative importance, are as follows.
    • Price to the consumer (most important). Unless the consumer chooses a different sort order, results are ranked by estimated cost. For energy, this is the estimated annual cost based on the consumer's usage, meter type and location, including any applicable discounts. For other products, it is the most relevant cost measure for that product, such as monthly price, premium, or annual percentage rate.
    • Eligibility and availability. Products the consumer cannot obtain, for example because of their location, connection type, or the criteria they have entered, are not shown or appear lower.
    • Filters and sort options chosen by the consumer. Consumers can re-sort or filter by contract length, speed, green energy, provider and other features. These choices override the default order.
  2. Payment and ranking. In every category, whether you pay us commission, and the level of that commission, never affects where your products appear in our results. We do not sell featured or sponsored positions. Whether a consumer can switch to your product online through our website also does not affect its position.
  3. Our energy price comparisons are accredited by the Commission for Regulation of Utilities.
  4. We do not disclose algorithms or information that would allow consumers to be deceived or that would enable manipulation of our results.

Our own products and differentiated treatment

In short: we do not sell our own products, and we treat all partners in the same way.

  1. Bonkers does not supply energy, broadband or financial products of its own. We do not give any partner preferential treatment in how its products are ranked or presented, in the data it receives from us, or in the terms on which it uses our services.
  2. We do not offer ancillary goods or services to consumers through our website alongside your products.

Other places we may promote your products

In short: besides bonkers.ie, we may feature your products in our emails, articles, social media and partner websites.

  1. In addition to our comparison tables, we may market your products and services through the following channels:
    • our newsletters, price-change alerts and other emails to consumers who have agreed to receive them;
    • our editorial content, guides and the Price Change Calendar;
    • our social media channels; and
    • our other websites, including www.broadbandspeedtest.ie.
  2. If you do not want your products marketed through any of these channels, tell us and we will discuss whether that is possible under your Partner Agreement.

Your intellectual property

In short: you keep ownership of your brand and content. You let us use them only so we can show and promote your products.

  1. You keep all ownership of, and rights in, your trade marks, logos, product names, product information, tariff and pricing data, images and other content you provide to us ("Your Content").
  2. You grant us a non-exclusive, royalty-free licence to use, reproduce and display Your Content for the duration of your Partner Agreement, only to provide our services and the marketing described in section 5. We may adjust the format of Your Content so it displays consistently on our website, but we will not change its meaning.
  3. This licence ends when your Partner Agreement ends. We will remove Your Content from our live comparison tables within 10 working days, but archived editorial content and emails already sent may continue to refer to your products.
  4. Our website, comparison tools, software and the bonkers.ie brand remain our property.

Suspension, restriction and termination

In short: we can restrict or end our service only for the reasons listed here, and we will explain why in writing.

  1. We may suspend, restrict, or remove some or all of your products from our services if:
    • you materially breach your Partner Agreement or these terms;
    • information you provide about your products, prices or availability is inaccurate or misleading and you do not correct it promptly once we tell you;
    • you become unable to accept new customers or to supply the products shown;
    • a regulator, court or law requires us to do so, or continuing would put us in breach of our regulatory obligations, including our CRU accreditation or Central Bank of Ireland requirements;
    • we have reasonable grounds to suspect fraud, or practices that cause or risk serious harm to consumers;
    • you become insolvent or cease trading; or
    • you stop paying fees due under your Partner Agreement.
  2. Statement of reasons. If we suspend or restrict your products, we will give you a written statement of reasons on a durable medium before or at the time the decision takes effect. It will refer to the specific facts and the ground in section 7.1 that applies.
  3. Termination. If we decide to end our services to you completely, we will give you at least 30 days' notice on a durable medium with a statement of reasons. This notice period does not apply if a law or regulator requires immediate termination, if we are exercising a right to terminate for a compelling reason under national law, or if you have repeatedly breached these terms.
  4. You can contact us at partners@bonkers.ie to clarify the facts that led to any of these decisions. If we reverse a decision, we will restore your products without undue delay.
  5. You may end your Partner Agreement on the notice set out in it.

Data

In short: this explains what data we and you can each access, and what happens to it when our relationship ends.

  1. Data you receive. When a consumer applies for your product through our website, we pass to you the personal data the consumer provides in the application, as described in our Privacy Policy. We also give you reports on the volume of applications for your products and your relative position by application volume. These reports do not identify other partners.
  2. Data we keep. We keep consumer data collected through our website in line with our Privacy Policy and data protection law. We also keep aggregated data about how consumers interact with our comparison results, including views, clicks and applications by product.
  3. Data we do not share. We do not share with you personal data about consumers who have not applied for your product. We do not share data you provide to us, or data about your products' performance, with other partners, except in aggregated form that does not identify you.
  4. After termination. When your Partner Agreement ends, you keep the data you received during it, subject to data protection law. We will keep data relating to your products only as long as needed for legal, regulatory, accounting and dispute-resolution purposes.

Offering different conditions elsewhere

In short: we explain here whether we restrict you from offering better deals through other channels.

  1. We do not restrict you from offering your products to consumers on different terms through your own website or through other comparison or sales channels, except for exclusive offers that we have agreed with you in writing for a defined period.

Mediation

In short: if we have a dispute that we cannot resolve between us, either of us can propose mediation.

  1. Bonkers qualifies as a small enterprise, so Article 12 of the P2B Regulation does not currently require us to offer mediation. We nonetheless offer it voluntarily. We are willing to try to resolve disputes with you through mediation. We will engage in mediation in good faith.
  2. We are willing to engage with either of the following, at your choice, to appoint an independent mediator:
    • The Mediators’ Institute of Ireland, Coleraine House, Coleraine Street, Dublin 7, D07 E8XF (www.themii.ie); or
    • The Chartered Institute of Arbitrators, Irish Branch, The Distillery Building, 145–151 Church Street, Dublin 7, D07 WDX8 (www.ciarb.ie).
  3. We will pay a reasonable share of the mediation costs, decided by the mediator, taking into account the merits of each side's position and the conduct of the parties.
  4. Mediation is voluntary and does not affect either party's right to go to court at any time.

Changes to these terms

In short: we will give you at least 15 days' written notice of any change, and you can end your agreement if you do not accept it.

  1. We will notify you of any proposed change to these terms by email, with the updated terms attached or linked, at least 15 days before it takes effect. We will give longer notice where a change requires you to make significant technical or commercial adjustments.
  2. If you do not accept a change, you may terminate your Partner Agreement before the notice period ends. Termination takes effect within 15 days of receiving the notice, unless a shorter period applies under your Partner Agreement.
  3. The notice period does not apply where a change is required by law or a regulator, or is needed to address an unforeseen and imminent danger relating to fraud, malware, spam, data breaches or other cybersecurity risks. You may also waive the notice period in writing or by clear affirmative action, such as submitting new products.
  4. We will not make changes with retroactive effect, unless required by law or the change is to your benefit.

Law, contact and version history

  1. These terms are governed by the laws of Ireland. The courts of Ireland have jurisdiction, without prejudice to section 10 or to any right a representative organisation or public body has to bring proceedings under Article 14 of the P2B Regulation.
  2. For questions about these terms, contact partners@bonkers.ie.
